Antler points and regulations

Have been scouting a ton this year in the B zone area. Have located a very nice non-typical buck that is a heavy horned 3 point with large eye gaurd on right side and a giant spike horn on the left also with large eye gaurd. Would that buck be legal to take?

straight from the Ca Big game digest "Forked Horn Buck - A male deer having a branched antler on either side with the branch in the upper two-thirds of the antler. Eyegaurds or other bony projections on the lower one-third of the antler shall not be considered as points or branches. (CCR T14-351(a)).

And I was always told that the "branch" on the upper 2/3 only has to be big enough that a ring will hang on the projection without falling off
