State game wardens Tuesday arrested a San Jose man for allegedly poaching sturgeon in the Sacramento River and cited two restaurants for allegedly selling the fish to patrons.
Tam Duc Truong, 55, of San Jose was observed by a California Fish and Game warden on Jan. 21 illegally catching sturgeon, said department spokesman Patrick Foy. Truong fished the banks of the Sacramento River on the Yolo and Sacramento county shores.
The warden saw Truong catch six white sturgeon in four days, which violates both daily and annual catch limits, Foy said. Some also exceeded the 56-inch size limit.
Surveillance revealed Truong allegedly selling the fish to two San Jose restaurants – the Mang Ha Quan restaurant on Senter Road and Huang Thao restaurant on Alvin Avenue – which then allegedly sold the fish to customers.
At one eatery, Foy said, "Not only did we find sturgeon in the freezer, but we found handmade signs tacked up on the wall that listed various ways the sturgeon was prepared."
Truong was booked into the Santa Clara County jail. The restaurant owners were cited. They face potential fines of $5,000 to $10,000 and a year in jail under a 2007 law meant to control poaching of sturgeon, a species in decline.
