Just a warning to all of my fellow hunters out there, be careful what you post on the internet, you never know when you are going to wind up being somebodies advertisement. Here's our story

When we found out my husband got his Owens Valley Archery Elk tag for August of 2011 we were elated, we were both born and raised in this valley and our families have been here for generations, hunting is more than just a hobby of ours it is a way of life. We feed our family primarily off of the game we kill each year and are already instilling the valuable lessons of honesty, integrity, and etiquette in the field into our two boys. For my husband this hunt was the opportunity of a lifetime, not once did we ever consider using a hunting guide service, unfortunately a hunting guide service decided to use us.


Shortly after my husband took a nice 6X6 myself and one of the men who was on the hunt with him posted the picture of his elk on our Facebook pages, we were thrilled for him and wanted to show off this major achievement to all of our family and friends and thanks to the internet it worked.

About 2 months later it was brought to our attention that the picture of my husband’s elk had been added to a page for a hunting guide service, Jerry’s Hunting Guide Service, out of Independence, Ca . It had been listed in an album along with all of the other successful hunts that he guided that year, implying that my husband’s elk was among that group. Wrote on his wall and on the picture asking that he take this photo down, but he refused.

I would never knock a guy for trying to make a living doing what he loves, but taking credit for a hunt that you weren’t involved in is just plain wrong. Perhaps I should have showed better judgment by not posting a picture of my husband’s elk on the internet, but I suppose that I just assumed that any person with any integrity or hunting etiquette, who truly valued the sport, would never even consider doing something so dishonest. A person with this type of character is certainly not somebody who should be getting any of our business.

One of my law clerk friends says that's it's surprisingly hard to find lawyers who are willing to dive into copyright violations on the internet. Doesn't mean you guys don't own that photo, or that the guy isn't a thief and an ass for stealing it and misrepresenting it as his, but you'll probably get the most response out of Facebook, who seem to come down fairly hard on things like that, once they know about them. I've had photos stolen before too, and it chaps my hide.

I have reported him to facebook and they are "looking into it," I just reported him today, I wanted to give him the opportunity to take it down on his own.

I just saw the picture MoRay I hope you get this a-hole in big trouble I think you should be able to sue that isnt right good luck getting that picture down the guy has not credibility

Yep, if given that the facts reported are true, this is clearly a copyright violation, along with a complete misrepresentation of his guide service, I am almost always one to try to resolve these type of matters without taking such measures, but once in a while, we run across someone that just needs to be sued, there are lawyers that specialize in copyright law (there not to difficult to find), but I would venture to guess that since you cannot prove monetary damages that despite this being a slam dunk case, it likely would not be worth the time, effort, nor cost.

Well it looks like a little pressure from those of you that posted on his link and from a myriad of Facebook followers was all we needed. He just took the photo down and apologized. Thanks for all of the advice and help, I'm sure that this guy wont be making this mistake again, but just in case I will be keeping the link to his page handy.

He has guided a few people I know down there and I have herd nothing but good things about him. I see he has corrected his facebook page.

I found another interesting picture on his site... Might not mean a thing but I know I have seen this picture on here at Jesse's. If memory serves, someone killed this deer and someone else on here recognized it from it's unusual rack and said they had a picture of it on the hoof and posted the pic. Maybe it was this guy from the guide service who posted it here? Maybe not, but considering the above, might be worth checking out to see if it's a pattern?
