Teal Lake’s Ban on Gas-Powered Motors May be Repealed
Negaunee, Mich. — A ban on gasoline-powered motorboats on Teal Lake that dates back more than 50 years may have to be jettisoned.
In a Feb. 18 letter to Negaunee City Manager Thomas Manninen, the DNR states that the city’s Prohibition of Motorboats Ordinance is not enforceable and must be repealed.
“The criteria for establishing a local ordinance is there has to be an ongoing marine safety concern that’s not primarily covered by using existing state law,” according to the letter from Ozzie Bryant, a DNR marine safety specialist. “A review of your ordinance does not disclose any marine safety concerns that are not primarily covered by using existing state law.”
The decades-old ban has been challenged since 1994, when Negaunee changed its municipal water supply from Teal Lake to an underground system. District Judge Patricia Micklow ruled in 1996 that the ordinance was a reasonable way to ensure the continued purity of the water for human consumption in case of an emergency.
