O.K. guys here goes!

was it too far of a shot for them? don't know, wasn't there
should Jimm have shot? yes
is it b.s. that they lied about not seeing the elk go down? yes
whose elk is it? not jim's, they had it hit in the leg and hind quarter, if it was a grazing wound it would have been jim's animal.
was jim walking away the best thing to do? yes

jim got to finish an animal, and take a picture with it. then he gets to go hunt some more, it's like a free tag. I wish it would happen to me once or twice a year.

There was a time in my life where I thought I was the biggest hardass on the planet and I walked around trying to prove it to just about anybody. Those days are long gone. Fighting is reserved for things that really matter, not a stupid animal. Getting into an argument with an armed stranger who is already proven that he lacks integrity (by laying claim to somebody else's critter) is just plain stupid. I've got a wife, children, and other responsibilities. I'm not going to put them in danger over a dang deer. It's sad that a guy would want to prove what a "man" he is in such a situation. Won't it be a great moment when his wife and kids are standing over his grave saying, "He was a dim bulb, but by God they had to pry that elk out of his cold, dead fingers." Protecting your family and yourself is a cause worthy of risking your life. An elk/deer/'lope is not.

Huntducks, are you saying that someone fired a handgun during the commission of a robbery(your deer, your bow)in the state of california? And the courts let them go. Isn't there a mandatory 10 year sentence for discharging a firearm in the commision of a crime?

[QAs far as physically fighting, you guy's need to quit being sissy's, you don't have to kill someone every time you have a disagreement, haven't you ever fought someone and shook his hand when it 's over? I have good friend's that I've had fight's with, maybe it's my" country boy" mentallity. Huntduck's, you're crazy for wanting to shoot someone over an animal, period.

I think just about everything else has been said the ethics of whose elk it is, I just wanted to comment on this quote, just in case someone is gonna take Cinco's advice.
As far as fighting with a stranger with the thought that when you are done you will be shaking hands afterwards, this is totally foolhardy.my life is worth to much to think that is gonna happen. Maybe when you were 12 and you got into a rough and tumble with your best freind you shook hands afterward.

If i was to get into a fight now, i (and anyone else with any sense) would do anything within my power to make them unable to hurt me. This means broken bones, unconcious etc.... you have no idea what your adversary is capable of doing to you if you dont do it to them first. For this very reason i am gonna avoid physical fights unless i have no choice. I got to much to lose and a family that needs me to put myself in a position to be killed or put in jail.

Fighting over an elk has gotta be one of the ridiculous things i have ever read on this site. And further more to make it a question of you being a sissy. What kind of challenge/taunt is that?? Someone is gonna read that and take it seriously.

Regarding the elk, you did the right thing. My experience tells me that taking the high road is almost always the best route. I am sure you dont regret how you handled it.

That's right they plea bargained it to shooting a deer out of season, not having the right tag, transporting a untagged game animal, and there was a couple other violations I don't remember this was 12 years ago.

He told police his gun discharged when he was putting it back in his holster, after shooting the deer hell he did not even have a holster, the deer must have been just twiching he did not even have to shoot I had put a shaft right thru it's lung it was my word aginst the 2 of them, as far as my bow it was found at the end of the dirt road and they knew nothing about it, course that where they thru it out of there truck they said I must have dropped it walking back to my truck, my truck was over a mile away from where my bow was found and long out of my way, they ran my bow over turning around, but I did get restution I got both of there bows and archery gear that were conficated as replacements to keep use or sell, I also got the antlers after all was finished DFG warden called and offered them to me along with his i'm sorry these guys did not do jail time, they got like 500 hrs CS.

I'm glad someone know's the difference in standing up for your rights and being a sissy. jimm and his friend fought the fight their way and walked away with two new friends, they shook hands at the kill site and settled it there(that was the whatever it takes part). And if reading anything on the internet threatens you or literally makes you mad enough to brawl, you need to stay off the computer and get some help.
