Well my wife called me today and said that Im being arraigned for DFG code 2536 guiding without a LIC(letter came in the mail) for the Camp Roberts fundraiser auctionon April 7th 2004 at the KING CITY COURT HOUSE. I just emailed my congressman and trying to get a hold of JAG now for an attorney to rep me.

THIS IS THE LAST TIME I EVER HELP THE MILITARY.

Just tell me who to call or write. I never once thought you were guiding and I was at all of those hunts at CR last year.

There is something we can do. With the great number of people on this forum knowing that you didn't guide, we can make our voices heard. This should help somehow. Just let us know in what other ways we can help (like fees, etc.)

The posts were pretty darn clear about what was happening. I would hope those posts and a statement from the folks who went on the hunt would clear all this up.

To show our support to BoarTracks, lets also stop hunting there.

I know this is a hard one, because it does offer some good hunting.

If we stop going there, they will feel the pain without our paying dollars at the gate.

I have only hunted there once so I am not totally sure where the money goes but this could also show our support.

Man that suck for him. He offered us all lotss of info.

They are going after you for something you did for a fund raiser? Surely level heads will prevail......never heard of such a crazy thing.......ya'll must have got rid of all the crime out there for them to go after people that try to help other people out.Good luck to you....I in for the helping.

That doesnt suprize me one bit.

Your probably best having one person write a letter and everyone else copy it and sign it. Have everyone send one copy to the person its abuot and send one copy to the dfg or whoevers in charge of it.

Let us know how it goes. Its too bad really. Someone trying to help others out and for that they get pinned against the wall.

I have a hard time seeing them prove you were guiding without a license since you personally did not receive compensation for the hunt. It would be like anyone of us not getting drawn for an area and a friend did but doesn't know the area and you offer to take them out and show them where to hunt. I don't think that is guiding under the law.

That is very true. I wondering what the bases of the case would be.

That's just it Heathen...they aren't even CLOSE to cleanin' up the "Crime" issues so they put ALL their collective energy's into $H!T like this here!!! Your a proud Texas Son and you'd have to know a little more about CA and the Political "Machine" ha,ha,ha,ha,ha (excuse me, that always happens) that WE "Locals" have to endure! And "WE" hunters are always under the Gun for some sort of legislature or another!!! :-( I agree with Hogskin...Lowell, let us know how we can help, either with our collective voice or some $$$$, or something!

Here is the DFG definition of a guide:

1. Guide Defined
A guide is defined as any person who is engaged in the business of packing or guiding, or who, for compensation, assists another person in taking or attempting to take any bird, mammal, fish, amphibian, or reptile or who, for compensation, assists another person in locating any bird, mammal, fish, amphibian or reptile to photograph or view. "Guide" includes any person who, for profit, transports other persons, their equipment or both to or from a hunting or fishing area.


Again, I point out that you have to be compensated to be a guide. Someone has their panties in a wad if you ask me. I'll sign any letters that need it.

Totally agree, Kentuck. Again, I think this is somebody who has some blood in their eyes and has an axe to grind, the truth be damned. I don't understand why the swinging dick over there doesn't take a personal look into it and then clear Boar Tracks. When things like this happen, it's a black eye on Camp Roberts as a whole. I wonder if getting in touch with a reporter at the local rag would be a good idea? Maybe make this thing a public matter up there. Wish there was something I could do and if there is, I will.

if some one will type one and post it so we can down load it in good formation with correct spelling i would be glad to send it any where it need to go with my signature on it lowell is a great guy and deserves all our support

2536. (a) It is unlawful for any person to engage in the business
of guiding or packing, or to act as a guide for any consideration or
compensation whatever, without first having secured a guide license
from the department.
(b) An employee of a licensee who acts as a guide only in
connection with, and within the scope of, his or her employment is
exempt from the requirement of subdivision (a) if all of the
following conditions are met:
(1) If the employment is subject to and the person is reported to
the carrier of the employer's workers' compensation insurance.
(2) If the person is subject and reported to the state and federal
taxing authorities for withholding of income tax.
(3) If the person is reported to the department, on forms provided
by the department, as an employee of the guide prior to any contact
with any person being guided, and a registration fee has been paid.
The base fee for an employee guide registration for the 2004 license
year shall be thirty-three dollars ($33), which shall be adjusted
annually thereafter pursuant to Section 713.
© A person who is licensed in another state to provide guide
services for the purposes of fishing is exempt from the requirements
of subdivision (a) if all of the following conditions are met:
(1) The state in which the person is licensed grants a similar
exemption to licensed guides who are residents of this state.
(2) Evidence of a valid guide license is provided to the
department upon request.
(3) The person is engaged in the business of guiding only in
conjunction with and during the term of a multistate fishing
tournament approved by the appropriate agency in each of the affected
states.
(4) The tournament sponsor provides to the department any
information or documents necessary to administer and enforce this
paragraph, as determined by the department, including, but not
limited to, the identities of all guides participating in the
tournament, verification of another state's license exemption, and
information sufficient to determine the validity of another state's
guide licenses.
(5) The tournament sponsor pays the department an amount,
determined by the department, to be sufficient to cover the
department's cost to administer and enforce this subdivision.
(6) The net proceeds of the tournament are used for resource
management projects or habitat improvement projects, or both.

Just to let you all know, Im going to try to post the letter, By the way I talked to speckmisser today and NO investigator talked to him. I tried to talk to one of the FHL police tonight and he walked away saying he did not hear anything. Im going to KSBY the local news after I get off of here. The lettercame from Mary Tatum Deputy DA Monterey County (831)385-8325 case no. 245768.

Just to let all Know I have never asked for money or anything, This was my M-day job to help promote CR. And of all things MY EX CR co Col Hatch asked me today, before I found out about the charges to take him and a number of BIG HIGH RANKING OFFICERS HUNTING AT CR, But this weekend, ummmm I did not think that season started til May. And I have it in writting from his email. So I do not Know what to do now so your help would be great. I don't know what the fine or jail is so if someone knows let me know. BUT I WILL FIGHT THIS< TO THE END.

good luck lowell i hope we can be of help to you i know from presonal experince that the judge at king city is a b#$ch and like to make good examples out of good people i have a couple of good buddies that are attornys and if you need them let me know i will see what they can do for you they helped me but not much she doesnt like out of town attornys tring to tell her the laws btw i called dfg but it was closed will call back in the morning
if they are charging this as a mistamener it is up to 3000.00 and or 1 year mine was 2500.00 and 1 day jail and 3 years probation hoply you can get off
