I've never met Lowell, but from what I have heard here about all this I'll sign any petition or help in any way I can. If it will help I'll head up that way for the arraignment as a show of support. Let us know how we can help & we will. Good luck to you.

Man, this just really sucks. Go figure - there are already a million frivolous lawsuits here in California - why do you think we pay sooooo much for our car insurance, and now the DFG has to get in on the action too??? No wonder people move out of this stupid state! What a bunch of BS. And you can bet it's a buddy buddy club. I'd lay money that that Jerk Off warden whoever he is has tried many a case with that Maroon D.A. who's prosecuting you.

You probably don't remember me, but we spoke 6 or 8 months ago. I was gathering some information on hunting CR. You were VERY helpfull and answered more questions than I thought anyone would. And NEVER, I mean NEVER was the mention of money made.

I'll write a letter that says just that - if nothing else, to help clog the mailboxes of the idiots who should have stopped this a long time ago!

Get on those JAG's and go public. The news loves a good "Honest Hero VS The Giant" story.

Have never met you nor PM or emailed you but GOOD LUCK, good things happen to good people, so what ever it takes don't give an inch.

Maybe someone can answer this, the GW at CR is he military or DFG???

Once again your a good man for doing what you have done and with the support of friends and military I see nothing but a good ending.

I hope it was a State DFG ofcr.
I can't imagine the Military filing through a county's D.A.
But then again, who would've thought an enforcement ofcr. could screw over a member of our military without getting his facts straight.

B.T. serves our Country and does so freely and without reservation.
Who the @!$# does this guy think he is? The law requires that full disclosure be made by peace officers including that which may prove a subject innocent. If this
"Officer" had truly been doing his job, he would have investigated more thouroughly and found this to be a waste in so many ways.

And what about the "Human Factor", this is a fund raiser for the families
of Men.....no no no Great Men and Women who leave their families and homes to fight the enemy in foriegn land and again, they do so selflessly.

Great!!! there I go again!!! I've gone from

If you don't have the cash for an Attorney you may want to consider making a plea and throwing yourself on the mercy of the court (No Contest). They go by the letter of the law, you should seek legal assistants, and I don't mean JAG. I would say seek legal assistants in King City (like someone already said), or at least in that area. Judges, Defense Attorneys, and District Attorneys that work in the same court hang together and you won't have a chance.

The Court only will let the Jury hear what is relevant to your case, and being a good Solder is not going to get it. If you cop a plea you can get diversion if this if you frist offence. And after you finish the sentence you can have your record cleared. I’m no expert, but from my 48 years, my experiences tell me this is how the courts work.

If I look at the letter of the Law it is clear that someone or group was compensated. And that’s all the court wants to know. Remember, they don't want to hear about how good of a Solder you have been, although that may help if you make a plea when sentencing.

With all the JHOL Police members they should and can tell you how the courts work. You need money to maybe win your.

By the way in 1975-1977 I was station at Ft. Ord and spent a 6 mounts stint at Ft. HL and CR.

Good Luck, and I wish you Gods Speed.

PS
They instruct the Jury something like this, “All that the State has to prove is that compensation was given for pointing out the direction to where the hogs where, weather taken or not”.

How many of you FHL/CR hunters have paid a fee to hunt with a guide\landowner in monterey county?

I can't comment on any of this other than what I've read here, but I am here for any type of support I can offer as well. This is very shameful on the part of the State.

Just checking back in after being out of town for a few days. However this plays out, it's gratifying read the posts and see that strangers still care about each other.

Is the District Attorney in the county an elected position? I really hope that our government employees and elected officials think this through to ensure that common sense and decency prevail.

Given the current climate I could see this snowballing into a local recall campaign if this thing goes south on you.

Best of luck,

NI

tony270 does have a point. All they have to do is prove that there was "some" kind of compensation for the hunt itself. I believe this is wrong and that the local Game Warden should of issued a warning first.

I do not know all the facts of the charity auction itself and don't claim to be a legal expert. But I would think that the charges should of been filed against who ever sponsered the event ie: Post Commander, Company Commander ect ect ect...... all in all. This is total BS. I think that the Military should step in and back Lowell 120% and that the Governor should be notified immediately.

News crews would eat this up. Imagine the press. (Headlines) California Department of Fish and Game goes after Soldier for a Charitable Event !

I'm sorry for ranting.... but this is bull ! And I feel that the more press this gets the more of a black eye the DA and DFG will have. This charge should be dropped immediately and a warning given in its place.

The next time you go hunting or fishing and you take someone with you. And they offer to help pay for gas or lunch. You better refuse. This is compensation for guideing without a license.

Behind you 120 % Lowell.............. All the way from the heartland.

First of all, I'd just like to personally thank Lowell for his efforts to help the families of deployed and activated soldiers. It is a great thing you're doing. I'm sure you already have taken this action, but remember that when JAG approved the event in the first place they took on certain responsibility. Even if there was a disclaimer in the paperwork, you should insure they take responsibility for leading you astray if that is what they did. Also, you seem to have an in with the Co, take advantage of that and utilize his power to make things happen on the Military end (JAG). Just you on your own telling JAG what to do will be nothing compared to having him back you. In the past when I was on Hunter Liggett I heard about someone with Federal Police or something of that nature who always gave hunters problems, but that they elliminated him, can this be done with the DFG personell?

Just a thought.

For what it is worth Boar Tracks, should it go as far as the first hearing, a 'not guilty' plea will set a whole bunch of mechanisms in action that will help you. Prior to that plea, clerks will handle your case. You might not get anyone to hear you. After the hearing, the DA get involved because they will have to decide how to move forward. It's at that point that they will really listen to you and see how pointless the case is. They might even get mad at the person who issued the citation.

This makes me wish I had taken the job at CR, even with the large cut in pay. That way I could be there to stand with you lowell, and help you fight this, for this is totaly wrong. Just plain totaly wrong !!

I will be sending off an email in letter format as will..

Boar Tracks:

Sorry to hear of your plight. I've seldom posted here before but have enjoyed the dialogue... especially as you and others have provided all that free, helpful advice to so many. It's a shame that baseless charges have evolved from your good intentions.

Though I am not an attorney, much of my work involves technical and persuasive writing. If you'd care to contact me, it would be my pleasure to craft a letter or two to support your side from a non-legal perspective as suggested by several others.

Best regards,

Dan

I wonder how things went? I received an interesting letter from the DFG - the Captain in Monterrey says that the Ft. Hunter LIggett Federal Police were the investigators in this case and that they referred the matter to the DA.

I hope it went well for Lowell yesterday.
