For the purposes of record keeping (P&Y, CBH, etc...), they are mule deer.
From a genetics standpoint, there is no way to tell unless someone ponies up a few thousand for the test. Annecdotes, and the appearence of a tail, or horns, in and of themselves, are not conclusive at all.
Accordingly, to me, as a certified measurer, they are mule deer... however, most hobbyists will call them hybrids based on what they think they should be (as opposed to a science-based, or other concrete criteria explanation).
